Sonus Health – Terms of Service & User Agreement

Welcome to the Sonus Health App ("App"), owned and operated by Decorte Future Industries ("Company," "we," "us," "our"). By downloading, accessing, or using the App, you ("User," "you") agree to be bound by these Terms of Service & User Agreement ("Agreement"). If you do not agree to these terms, do not use the App.

1. No Medical Advice & Wellness-Only Disclaimer

  • The Sonus Health App is not a medical device and does not provide medical advice, diagnosis, treatment, or cure for any condition.

  • The App provides general wellness information based on sound analysis and does not replace clinical testing, medical evaluation, or professional consultation.

  • Any results, insights, or data provided by the App are for informational and wellness purposes only and should not be used as a basis for medical decisions.

2. Seek Medical Attention When Necessary

  • If you experience any symptoms, health concerns, or abnormalities, you should immediately seek medical attention from a licensed healthcare provider.

  • A "normal" result from the App does not mean you are free from any medical condition. Likewise, if an irregularity is detected, you should consult a healthcare professional for further evaluation.

  • Under no circumstances should the App be used as a substitute for emergency medical care. If you are experiencing chest pain, difficulty breathing, dizziness, or other urgent symptoms, call 911 or your local emergency services immediately.

3. User Eligibility & Responsibilities

  • You must be at least 18 years old (or the age of majority in your jurisdiction) to use the App.

  • By using the App, you confirm that you understand and accept that the App does not provide medical services.

  • You agree not to misuse the App, attempt to modify its functionality, or use it in any way that violates local laws.

4. No Liability for Medical Outcomes

By using the App, you acknowledge and agree that:

  • Decorte Future Industries, its affiliates, employees, licensors, and partners are not responsible for any medical decisions, harm, or adverse outcomes that may result from using the App.

  • We make no guarantees regarding the accuracy, reliability, or completeness of the data provided by the App.

  • You assume full responsibility and risk for any use of the App and its outputs.

  • To the fullest extent permitted by law, we disclaim all warranties (express or implied), including but not limited to merchantability, fitness for a particular purpose, and non-infringement.

5. Limitation of Liability

To the maximum extent permitted by applicable law, in no event shall Decorte Future Industries, its affiliates, officers, employees, or licensors be liable for:

  • Any direct, indirect, incidental, special, consequential, or punitive damages.

  • Any health issues, injuries, illnesses, or medical conditions arising from use or reliance on the App.

  • Any loss of data, revenue, business, or personal well-being associated with App use.

  • Any third-party claims, even if we have been advised of the possibility of such damages.

6. Indemnification

By using the App, you agree to defend, indemnify, and hold harmless Decorte Future Industries from any claims, liabilities, damages, legal fees, or disputes arising from:

  • Your use of the App.

  • Your reliance on the App’s data.

  • Any violation of these Terms.

7. Refund and Disputes, Cancellation and Promotions

  • Any user can claim a full refund of the monthly fee any time during the first month of use if the service does not meet expectations. This can only be claimed once per user and any user who is found to sign up using different email addresses or to refund their first month more than once in two years will be required to pay for any additional months they may have used the app on top of the one refunded month.

  • Any user who has been using the app for more than one month can receive a refund if they have not yet performed any scans that month. If they have already performed scans that month they will be required to pay for the month.

  • Cancellation can happen at any time on the monthly plan, and with a fixed monetary penalty for early cancellation on the discounted yearly plan (see the rates listed under the yearly plan once available).

8. No Warranties & App Availability

  • The App is provided "as is" and "as available." We do not guarantee uninterrupted, error-free, or bug-free operation.

  • We reserve the right to modify, suspend, or terminate the App at any time without liability or notice.

9. Privacy & Data Collection

  • We collect, store, and process non-medical personal data in accordance with our Privacy Policy.

  • Your data will not be shared with third parties without your consent, except as required by law.

10. Governing Law & Dispute Resolution

  • This Agreement shall be governed by the laws of England, UK, without regard to conflict of laws principles.

  • Any disputes must be resolved through binding arbitration in England UK, and you waive the right to a jury trial or class action.

11. Changes to This Agreement

  • We may update these Terms at any time. Your continued use of the App after changes constitutes acceptance of the revised Terms.
